MyWork, LLC and our affiliates (“MyWork,” “we,” “us,” or “our”) respect the privacy of our users (“you” or “your”). This Privacy Policy governs the mobile or web applications (“Apps”) and websites we and our affiliates, subsidiaries and related entities operate (collectively, the “Services”), and describes how we collect, use, and disclose personal information, and your rights in relation to that information.

What Does This Privacy Policy Cover?

This Privacy Policy covers our treatment of Personal Information and Other Information we gather from you when you are accessing or using our Services. Personal Information may include, but is not limited to, your name, username, home and/or work address, telephone number, e-mail address, company affiliation and associated interests. We collect some of this Personal Information by requesting it directly from you, and we may also obtain information about you from third-party sources, as described below.

Please note, this Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

What Information Does MyWork Collect?

1. Information You Provide to Us

We collect information you provide directly to us, such as when you create or modify your account and profile, request or provide services, contact customer support, or otherwise communicate with us. This information may include name, email, phone number, postal address, profile picture, payment method, items and services requested, delivery and service notes, and other information you choose to provide.

You can choose not to provide us with certain Personal Information, but then you may not be able to register with us or to take full advantage of our Services. We may also ask for additional information about items and services requested and delivery and service notes, and other information you may choose to provide in order to, for example, facilitate communications among users or to monitor work orders and invoices.

We may aggregate and/or anonymize your Personal Information so that you cannot be individually identified, and provide that information to our other customers, service providers, partners or other third parties, including, without limitation, to provide benchmarking data.

2. Information We Collect Through Your Use of Our Services

  • Transaction Information: check-in and check-out information, dispatch information, the type of Service requested or delivered, diagnostic fees, fee changes, final fees, the date and time the service was provided, and ratings feedback.
  • Location Information: where you consent through your mobile operating system, we may collect precise location data to determine if a user is on-site at a customer location; we may also approximate your current location using your IP address.
  • Contacts Information: where you consent, we may access names and contact information from your address book to facilitate interactions through our Services.
  • Device Information: hardware model, operating system and version, and other unique device identifiers.
  • Information Collected Automatically: server log information including IP address, the page you requested, App usage, App crashes, and other system activity.
  • Cookies and Similar Technologies: we and our service providers use cookies, pixels, local storage, and identifiers on our websites, in our emails, and within our apps.

Our use of these technologies falls into Strictly Necessary, Performance, Functionality, and Targeting categories. You can control cookies through your browser settings and other tools, as described further below.

3. Information We Receive from Third Parties and Publicly Available Sources

  • third parties that interact in some way with the Services or that provide services to us in connection with the Services;
  • third-party services, websites or apps that you use and that may share your Personal Information, activities and/or content with MyWork;
  • lead generation providers; and
  • publicly available sources such as public-facing profiles on company websites.

We may combine information from several sources, which means that we are not always able to identify the exact source of your personal information. If you would like to know more about where we obtained your personal information, please contact us by emailing privacy@mywork.one.

4. Personal Information from Children

Because of the nature of our business, our services are not provided to minors. We will not ask minors, specifically children under the age of 13, to provide personal information if we have knowledge of their age.

Use and Sharing of Information

We neither rent nor sell, aside from the definition of the term “sale” under the CCPA as outlined below, your Personal Information in personally identifiable form to anyone. However, we do use and share with third parties your Personal Information and Other Information as described below:

  • Service Providers: we employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you.
  • Customers: we make information available through the Services to customers to whom you provide your services or who provide services to you.
  • Payment Processors: we use third-party payment processors with which we share Personal Information in order to complete transactions on the Services. Presently, we use Stripe as our Payment Processor. Stripe’s privacy policy is found here.
  • Background Check Information: customers may use the Services to access third-party background check services, which may require providing personal information about the individuals subject to the check.
  • User Profiles and Submissions: profile information uploaded to the Services may be displayed to other users to facilitate user interaction.
  • Facilitate Communications Between Users: we enable communication between users — for example, between a customer and a service contractor — to initiate requests, provide ETAs, or assess fees.
  • Facilitate Communications Between MyWork and You: we may contact you about products, services, promotions, news, and events of MyWork and other companies, where permissible.
  • Services Provision, Maintenance and Upgrades: we use your information to provide, maintain, improve and personalize our Services, including sending receipts, developing new features, authenticating users, and preventing fraud.
  • Business Transfers: in a merger, acquisition, bankruptcy or other change of control, Personal Information may be one of the assets transferred.
  • Protection of MyWork and Others: we may access, preserve, and disclose information to comply with law, enforce our agreements, or protect the rights, property, or safety of MyWork, our employees, our users, or others.
  • With Your Consent: you will be notified when your Personal Information may be shared with third parties in personally identifiable form, and offered an opportunity to prevent the sharing of this information.
  • Internal Operations, Analytics and Testing: we use Personal and Other Information for fraud prevention, troubleshooting, analyses, testing, research, performance monitoring, and measuring the effectiveness of our marketing.
  • Aggregated and/or Anonymized Data: we may use anonymized data derived from your Personal Information for any purpose, but not in a manner that would identify you personally.
  • Advertisers: we may use third parties to administer MyWork advertisements; no Personal Information is provided to advertisers, though aggregate profile or Other Information may inform ad selection.
  • Other Information: we may use, transfer, and disclose Other Information we collect for any purpose, except where applicable law requires otherwise.

International Transfers

MyWork is headquartered in the United States and as such we process and store Personal Information and Other Information in the United States. As a result, United States federal and state governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in the United States.

We have taken appropriate safeguards to require that your personal information remains protected in accordance with this Privacy Policy. These include implementing Standard Contractual Clauses for transfers of personal information with our Service Providers and between our group companies, which require all group companies to protect personal information they process from the EEA and United Kingdom in accordance with European Union and United Kingdom data protection law, and from Brazil in accordance with Brazilian data protection law.

What Rights and Choices Do I Have?

1. User Account Information

You may correct your account information at any time by updating your account through the Services. If you wish to cancel your account, please email us at support@mywork.one. Some information may remain in our records after deletion. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.

MyWork will comply with individuals’ requests regarding access, correction, and/or deletion of the personal data it stores in accordance with applicable law.

2. Collection Technology Choices

Most web browsers have an option for turning off the cookie feature. Certain versions of iOS and Android also let you limit ad tracking. At this time, we do not honor Do Not Track (DNT) signals. Limiting cookies may worsen your overall user experience, and in some cases the Services will not work properly without cookies, local storage, and similar technologies.

You can manage your preferences for each cookie category (except strictly necessary cookies) by clicking “Your Privacy Choices” in the footer of our website. You may also exercise this right by broadcasting an opt-out preference signal, such as enabling Global Privacy Control (GPC) where supported by your browser.

3. Your European Privacy Rights

European Union and United Kingdom data subjects have the following rights, subject to certain exemptions, with respect to the personal information we hold:

  • The right to request access to the personal data we hold;
  • The right to request rectification of any inaccurate or incomplete personal data;
  • The right to request the deletion or erasure of the personal data;
  • The right to request that we restrict our processing of your personal data;
  • The right to object to the processing of your personal data; and
  • The right to request that your data be ported to another controller.

When processing is based on your consent, you may withdraw consent at any time. You have the right to opt-out of marketing communications by clicking “unsubscribe” in any marketing email. To exercise any of these rights, please contact us by emailing privacy@mywork.one. If you are not satisfied with our response, you also have the right to file a complaint with your supervisory authority.

4. Your Brazil Privacy Rights

Data subjects located in Brazil have the right to access, rectify, delete, and port their personal data, subject to certain exemptions. When processing is based on consent, you may withdraw consent at any time. To exercise these rights, please email privacy@mywork.one.

5. Your Nevada Privacy Rights

We do not sell your personal information. If you are a Nevada resident and would like to opt-out of any sale of your personal information, please email us at privacy@mywork.one or send a written request to MyWork, LLC, 7200 Center Street, Mentor, OH 44060. Please write “Your Nevada Privacy Rights” at the top of your request.

6. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (“CCPA”) applies to you. In the preceding twelve (12) months we have collected categories of personal information including Identifiers, Customer Records, Commercial Information, Internet/Network Activity, and Geolocation Data, and sensitive personal information limited to Precise Geolocation Data from our mobile application.

We have disclosed Identifiers, Customer Records, Commercial Information, Internet/Network Activity, and Geolocation Data to our service providers for business purposes. While MyWork does not sell personal information as traditionally defined, MyWork may sell and/or share Internet/Network activity and Geolocation Data to our cookie and tracker providers as those terms are defined under the CCPA. MyWork does not knowingly sell personal information of California consumers under the age of sixteen (16) years.

  • Right to Opt-Out of Sale and Sharing: via the Your Privacy Choices link in our website footer or by enabling GPC signals.
  • Right to Know: request that MyWork disclose the categories and specific pieces of personal information we have collected about you.
  • Right to Deletion: request that MyWork delete personal information we collected from you, subject to certain exceptions.
  • Right to Correction: request that MyWork correct inaccurate personal information we maintain about you.

To exercise your right to know, deletion, or correction, please e-mail us at privacy@mywork.one. We may require verification information. We will not discriminate against you for exercising any of your CCPA rights. You may designate an authorized agent in writing or through a power of attorney to make requests on your behalf.

California’s “Shine the Light” Law

Under California Civil Code sections 1798.83-1798.84, California residents may request once a year a notice identifying the categories of personal customer information we share with affiliates and/or third parties for their own direct marketing purposes. 7. Interest Based Advertising

We may partner with third parties to provide Interest Based Advertising. You can opt out via Your Online Choices (EU), the Network Advertising Initiative, or the Digital Advertising Alliance. By opting out, you may still see ads from MyWork, but you will stop receiving targeted ads based on your browsing activity across websites.

8. Do Not Track

At this time, we do not honor web browser Do Not Track (“DNT”) signals or similar mechanisms.

Data Retention

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).

We will hold Personal Information about you after you cancel your account for no more than two (2) years after the applicable account is deleted.

Marketing and Email Communication

We may use email to communicate with you, to send information that you have requested or to send information about other products or services developed or provided by us or our partners. If you do not want to receive commercial email or other mail from us, you may unsubscribe using the unsubscribe link at the bottom of any email you receive.

Please note that if you do not want to receive legal notices from us, such as notices regarding this Privacy Policy, those legal notices will still govern your use of the Services, and you are responsible for reviewing such legal notices for changes. We may receive a confirmation when you open an email from MyWork if your computer supports this type of program; we use this to make emails more interesting and helpful and to improve our service.

Security

MyWork uses commercially reasonable physical, electronic, and procedural safeguards to protect your Personal Information against loss or unauthorized access, use, modification, or deletion. However, no security program is foolproof, and thus we cannot guarantee the absolute security of your Personal Information or Other Information.

Changes to This Privacy Policy

We may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we use Personal Information, we will notify you by posting an announcement on our website or sending you a message. You are bound by any changes to the Privacy Policy when you use the Services after such changes have been first posted.
