Terms and Conditions

These Terms govern your access to and use of mywork's platform, APIs, websites, and related services. By registering for or using the Services, you agree to be bound by these Terms.

Definitions

  • Account: the account you create to access and use the Services.
  • Business User: an operator, facility owner, or other entity that uses mywork to manage work and accept services.
  • End Customer: a consumer or business that receives services arranged through the mywork platform.
  • Transaction: any payment, refund, payout, or transfer processed through the Services.
  • Applicable Law: all laws, regulations, rules, and guidelines applicable to the use of the Services in the relevant jurisdiction.

Eligibility and registration

To use the Services, you must be at least 18 years of age, a legal resident or registered business in a country where mywork operates, and have the legal capacity to enter into a binding contract.

When registering, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials. mywork reserves the right to decline registration or suspend accounts at its sole discretion.

Business Users must complete identity verification and, where required, Know Your Customer (KYC) and Know Your Business (KYB) checks before being permitted to process live transactions. Failure to complete verification may result in account limitations.

Services and account

mywork grants you a limited, non-exclusive, non-transferable licence to access and use the Services in accordance with these Terms. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

Your responsibilities

  • Ensure your use of the Services complies with all Applicable Laws, including consumer protection, data protection, and financial services regulations.
  • Maintain accurate and up-to-date account information at all times.
  • Implement appropriate security measures to prevent unauthorised access to your account.
  • Promptly notify mywork of any suspected unauthorised use or security breach.
  • Not use the Services in any manner that could damage, disable, or impair mywork's systems or networks.

Payment processing

mywork provides payment processing services as a technology platform working in conjunction with licensed payment service providers, acquiring banks, and card networks. By using the Services, you also agree to the applicable terms of these network partners.

  • You authorise mywork to hold, receive, and disburse funds on your behalf in connection with your use of the Services.
  • mywork may place reserves on your account if we reasonably determine that there is an elevated risk of chargebacks, refunds, or losses.
  • You are solely responsible for all goods, services, or content sold to End Customers and for handling any disputes, refunds, or chargebacks.
  • mywork may decline, reverse, or suspend any Transaction that we believe violates these Terms or Applicable Law.
  • You must respond to chargeback notifications within the timeframes specified by the relevant card network; failure to respond may result in automatic debits to your account.

Fees and settlement

Fees for using the Services are set out in your pricing agreement with mywork or on our pricing page. mywork reserves the right to change fees with reasonable advance notice. Your continued use of the Services after a fee change constitutes acceptance.

  • Processing fees: charged per transaction as a percentage of the transaction amount plus a fixed fee, varying by payment method and country.
  • Additional fees: may apply for optional features such as fraud protection, billing, or tax.
  • Settlement: funds are settled to your designated bank account on a rolling basis, typically within 2 to 7 business days depending on your account status and jurisdiction.
  • Refunds and chargebacks: processing fees are generally non-refundable; chargeback fees apply where set out in your pricing agreement.

mywork may set off amounts owed to us against funds held in your mywork balance before remitting any settlement to you.

Prohibited activities

You may not use the Services to process transactions related to the following categories, among others:

  • Illegal goods or services, including narcotics, controlled substances, or unlicensed gambling.
  • Counterfeit or stolen goods, or goods that infringe intellectual property rights.
  • Adult content or services not expressly permitted under a separate agreement with mywork.
  • Weapons, ammunition, or other regulated items without the required licences.
  • Multi-level marketing or pyramid schemes.
  • Any activity that violates sanctions administered by OFAC, the UN Security Council, or other applicable regulatory bodies.
  • Fraudulent, deceptive, or misleading transactions or representations to End Customers.

mywork may immediately terminate or restrict your account for any actual or suspected prohibited activity.

Intellectual property

All intellectual property rights in the Services, including software, APIs, documentation, trademarks, and logos, remain the property of mywork and its licensors. Nothing in these Terms transfers any ownership of intellectual property to you.

You grant mywork a limited, worldwide licence to use your trademarks and branding solely as needed to provide the Services. You may not use mywork's trademarks, logos, or brand assets without prior written consent.

Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other party in connection with these Terms that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure.

Confidentiality obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by law or regulation.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. mywork does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

mywork is not responsible for the actions or omissions of third-party payment networks, banks, or other service providers involved in processing transactions.

Limitation of liability

To the maximum extent permitted by applicable law, mywork's total liability to you for any claims arising from or related to these Terms or the Services shall not exceed the greater of (a) the fees you paid to mywork in the three months preceding the claim, or (b) USD $100.

In no event shall mywork be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of profits, loss of data, or business interruption, even if mywork has been advised of the possibility of such damages.

Some jurisdictions do not permit the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

Indemnification

You agree to indemnify, defend, and hold harmless mywork and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Services in violation of these Terms or Applicable Law.
  • Any goods or services you sell to End Customers.
  • Your breach of any representation, warranty, or obligation under these Terms.
  • Any claim brought by an End Customer, bank, card network, or regulatory authority arising from your business activities.

Term and termination

These Terms remain in effect from the date you first accept them until terminated by either party. You may terminate your account at any time by contacting mywork support. mywork may terminate or suspend your access immediately if:

  • You breach any provision of these Terms or our policies.
  • We are required to do so by Applicable Law or a regulatory authority.
  • We determine there is an unacceptable level of risk associated with your account.
  • You become insolvent or subject to bankruptcy, receivership, or similar proceedings.

Upon termination, your right to use the Services ceases immediately. mywork will settle outstanding balances according to these Terms, subject to any holds, offsets, or reserves. Provisions that by their nature should survive termination will remain in effect.

Dispute resolution

Before initiating any formal proceeding, each party agrees to attempt to resolve disputes informally by notifying the other party in writing and engaging in good-faith discussions for at least 30 days.

If informal resolution fails, disputes shall be resolved through binding arbitration administered by a recognised arbitration body, except that either party may seek injunctive relief from a court of competent jurisdiction to prevent irreparable harm.

Class action waiver: you agree that disputes will be resolved only on an individual basis and not as part of a class, consolidated, or representative action, to the fullest extent permitted by law.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles, except where Applicable Law in your jurisdiction requires otherwise.

For users in the European Economic Area, applicable EU consumer protection laws and mandatory local statutes shall apply where they provide greater protections than those set out here.

General provisions

  • Entire agreement: these Terms, together with any supplemental agreements and policies incorporated by reference, constitute the entire agreement between you and mywork regarding the Services.
  • Amendments: mywork may update these Terms at any time; material changes will be communicated with at least 30 days' notice; continued use of the Services constitutes acceptance.
  • Severability: if any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.
  • No waiver: mywork's failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: you may not assign or transfer your rights under these Terms without mywork's prior written consent; mywork may assign its rights and obligations freely.
  • Force majeure: neither party will be liable for delays or failures caused by events beyond their reasonable control, including natural disasters, government actions, or failures of third-party infrastructure.
